國家通訊傳播委員會（NCC）昨針對亞太電信「借用」台灣大哥大網路一案，通則性決議通過，業者可有條件使用別人網路提供服務，但雙方須事先向NCC提出事業計畫書變更申請核准，但借用者不得完全使用別人網路，也不得違法使用。由於上周亞太電再遭罰款30萬元，NCC接下來將對台灣大開罰。

NCC不認為亞太電使用台灣大網路的行為是「漫遊」，昨天對於行動寬頻業者不自建網路，或不使用自建網路，使用他人接取網路，做出通則性的原則決議，強調業者不論是借用，還是借出方，都必須先向NCC提出變更事業計畫書申請，經過核准後才可行，但借用方不能完全不使用自己的網路，也不能完全藉他人網路提供服務。NCC發言人虞孝成表示，亞太電及台灣大皆未提出變更事業計畫書申請，但上周NCC已針對亞太電未依建設計畫書建設，及未經核准即使用台灣大網路提供服務，欠缺有效保護機制等，再開罰30萬元，接下來對於台灣大的違規部分，也將開罰，但亞太電不需斷訊，也不會現在就不能使用台灣大網路。針對使用他人網路的事業計畫書變更審核準則，NCC表示約有37項之多，包括4G業者雖原則上應自建網路提供服務，但在未違反電信相關授權法規下，仍可向其它業者租用；另使用他人網路的比率，應逐年顯著下降，出借方也須說明如何維持足夠傳輸容量，及如何處理產生出多餘的訊務量。亞太電昨則表示，將遵循主管機關決定，並會儘速向NCC提出事業計畫書變更申請。(中國時報)，
